DarkSky Web Solutions Respects Your Privacy.
At DarkSky Web Solutions, we are committed to building long-lasting relationships based on trust. We recognize the importance of protecting all information our customers provide us. Please be assured that we will not sell, barter, rent, loan or otherwise disclose any of your personal information.

All web services provided by DarkSky Web Solutions may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless DarkSky Web Solutions from any claims resulting from the use of the service which damages the subscriber or any other party.

Examples of non-acceptable content or links:

Pirated software
Hackers programs or archives
Warez Sites
Gambling Sites with active gaming programs
Irc Bots
Use of copyrighted or otherwise protected material without permission.
Multiple hosts resolving at an IP address that we provide
Child pornography

CGI Scripts:
For each account that comes with its own cgi-bin, you are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effects normal server operation.

Cancellation:
All plans may be cancelled with 30 days notice by either party. Customers on yearly payment plans will be refunded the difference between what customer has paid and what customer would have paid under the equivalent monthly payment plan.

Uptime Guarantee:
DarkSky Web Solutions guarantees 99.9% uptime of your web sites or servers availability to the internet. If your website or server should ever fail to perform due to hardware or network failures within our control we will fix the problem and grant you a credit towards future service for the lost time. On rare occasions we will perform routine maintenance on our servers. However, we will only perform this maintenance during off peak hours and we will provide you with plenty of notice should this be required.

Dedicated Server customers are responsible for any activity conducted on their server, including unauthorized activity by hackers. This includes any AUP violations or bandwidth usage caused by hackers. DarkSky Web Solutions will endeavor to assist the customer but DarkSky Web Solutions is not responsible for protecting customers from hackers and their actions and use of Subscriber's server.

Email Abuse
Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, harrassments, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. We consider spam as any mass unsolicited message in the mediums of Newsgroups and Email. Spam will not be tolerated at any level.

DarkSky Web Solutions will be the sole arbiter as to what constitutes a violation of its policies. If you are found in violation of any of the DarkSky Web Solutions policies, your account will be terminated without notice and you will forfeit all of the moneys that have been paid to DarkSky Web Solutions.
